Western Sky Reviews – Legit or Scam?

Western Sky Financial is an installment loan company who claims that you can get up to $2,525 in your checking account overnight by completing an application that takes less than 5 minutes to fill out.
Western Sky Financial operates within the boundaries of the Cheyenne River Sioux Reservation, which is a sovereign nation within the United States. It is owned by an individual within that nation and not the Cheyenne River Sioux Reservation itself.
Recently, the Western Sky commercials have been generating a lot of buzz online, mostly because people find them humorous but also because some people are questioning the claims made in the commercial, specifically your ability to receive thousands of dollars overnight.
It Is Expensive, But There Is No Collateral Required
In the commercial, the spokesman claims “Yes, the money is expensive, but there is no collateral required.” This is a common theme within the payday loan industry.
Before you borrow money from Western Sky, look at their Rates page which describes the APR as well as the loan fee that will be assessed depending on the loan amount you are requesting.
The APR, or Annual Percentage Rate, is the amount of interest you will be required to pay back within a year. When loan companies do not require collateral or high credit scores to approve a loan, it is generally because the APR they charge is extremely high.
In the case of Western Sky, the lowest available APR is 116.73% and can be as high as 215.03%. This means that if you borrow $5,000 from Western Sky at 116.73% APR and take the full 84 months to pay it back, you will have paid $35,872.72 in interest.
The Bottom Line on Western Sky
In the US, individual states have laws that govern payday loan companies and are meant to protect the borrowers from extreme APRs and unrealistic payback schedules.
In the past when Reviewopedia has reviewed online payday loan companies, I have pointed out that borrowing from an online company that is based in another state may make it difficult for your state laws to protect you from predatory lending practices.
In the case of Western Sky, this is further complicated by the fact that Western Sky is based in the Cheyenne River Sioux Reservation, which acts as an independent nation within the US, meaning that you could potentially have no protection from them at all.

These adds can be misleading, the small print is so small it can not be seen, and it changes so fast the common person is unable to read it. If it is to good to be true perhaps it is!

Wow this is ridiculous I work for a bank, and have seen customers get money wired from western sky I feel really bad for them now that I seen what there gonna pay back. People just shouldn’t do it!!!!!

This is a shame that this company is allowed to fleese people that may not be educated enough not to fall in this trap of a loan that could ruin them forever. Who would apply for this foolishness. The elderly, the desperate, or the poor. When did we stop caring about people

I think the whole thing is hilarious. We can’t get mad for signing off on something that is a rip off. The commercial makes me chuckle, and so should everyone else. Don’t sign…. On the dotted line… LOL!! Good Day everyone. I enjoyed the reading each post. LMBO!

People, I understand your thinking about how much to pay back the loan IF you keep it for the term. It puts everything right out in the open, tells you it is a high rate, etc, and then it is your choice if you know you can pay back within a couple of months, its a good fast remedy when you need the cash. I can’t believe so many people actually put people/companies down for being a service that can help out, not require payback in a short amount of time — its all up to you. As I said, if an emergency, needed and can be paid back with a short amount of time, it is a fantastic option. No one is twisting your arm..and then there are those with the oh, since they’re not regulated, then I just won’t pay it back. How said our ways have become…screw me (or look as if you are screwing me) and I will screw you! So sad..

Sounds like MRM works for western sky, please correct me if i’m wrong. Their service if that’s what you’d like to call it isn’t helping anybody. I don’t see how any loan with an apr of 116% could do anything but harm. especially since their target consumer is somebody living paycheck to paycheck with bad credit. Cause if you had credit you can go to a bank and get a personal loan with a real apr most likely under 10% and if your not living paycheck to paycheck you don’t need a loan for 2grand. You shouldn’t have to pay a loan back in the first month for it to make sense. I’d also like to know what the prepayment penalty is like on one of these loans. I feel so bad for the person working paycheck to paycheck who gets sucked into one of these loans. Western sky is basically loading up a gun(with bad credit and debt for the rest of your life) and putting it to your head and pulling the trigger. I dont see any reason for somebody to get a loan like this. Western Sky is a disgusting company everybody who works for them should be ashamed of themselves. Yea western sky is out to help you,,,help them make their pockets fat. Last W.S. commercial i watched said we’ll loan you the money cause they trust you, yea they trust that you wont be able to pay it back so that they can sue you.

BUT, if you borrow $5000, and pay it back at $468 per month for 84 months you will pay $40000! This is 10 times higher than loan shark rates. These people aren’t out to help you, only faten there wallets and make your already troubled financial cituation dramatically worse.
May 5th, 2012 at 12:54 am
ok I know I’ll get approved for a 10k loan from western sky.
I need the money NOW so that’s the only reason I am thinking about it.
But I am 100% able to pay the loan off in less then 2 months.
Do they still charge you interest rate for 84 months and make you pay monthly for the loan or will I just be paying the interest rate for those 2 months I borrowed the loan?
I will ask them but wanted to know if you knew the answer

May 7th, 2012 at 8:20 pm
Dude why don’t you just go to a real bank? Most banks are willing to do personal loans for people for any reason and with not so good credit and you don’t have to worry about paying it off in 2 months. I got a personal loan about 6 years ago for like 7k monthly payments of like $214 with no prepay and my credit was in the 500rds. I dont see any reason to call these people, if you credit is that bad, get somebody to co-sign..anyway you cut it, it’s better then a 116% apr, dont do it to yourself
May 3rd, 2012 at 1:49 pm
While I agree that the rates are high, how is this any worse than a mortgage. I borrowed 145,000 in 2002 from Chase at 5%. In 30 years i will have paid them 251,000. So, thats not much better.
John says:
May 7th, 2012 at 8:25 pm
Sounds like your in an adjustable rate loan. cause at 5% that doesn’t add up, you should of refinanced out of that about 8years ago.
David says:

Jack your interest rate by about 115% and run that out your 30 years and I’ll bet you change your mind.

Yeah, I just happened across the commercial just this afternoon, and I scribbled the website address down so that I could check it out later online. After doing a little research, not to mention reading this article, NO THANKS. Keep it…lol

Oh this is awful! I almost called western sky out of desperation but after reading this, hell no! Thanks for the insight!
April 27th, 2012 at 9:01 am
I called for info and what the website fine print states is true. If you borrow 5,000 u would end up paying back a little over 40,000. You would make the least 486/mo for 84 months. I would think about it a billion times over before saying yes. I personally would never do it. I can buy a house with that kind of money.

April 23rd, 2012 at 9:07 am
I haven’t read all 5 pages of this blog, but what happens if you don’t pay? Do state usury laws protect people, or are folks left high and dry with rates higher than a loan shark would charge (though admittedly a longer term, and less likely to involve a bat or gun)? Just curious – seems like they could be put out of business pretty quickly if a few dozen people take out loans then never make a payment.

Sadly mistaken if you think that they can’t steal your identity or commit identity fraud with just SSN. Know someone right now going through this, someone used SSN and file income tax return and now there is a hold on return. A few years ago some applied for all kinds of credit using my mother SSN, stole her identity.

People, it is as simple as “There ain’t no such thing as a free lunch.” The best way to put them out of business is to NOT USE THE SERVICE. Don’t scream for the government or “someone” to do something about it. JUST DO NOT USE THE “SERVICE” AND GO ABOUT YOUR BUSINESS.

That’s exactly what I’m thinking. Since they are technically not a US entity, and I don’t have protection from them, does this mean they don’t have protection against me? Like, if they sue me for the money, would I be protected by my government? If so, sign me up, high interest rate and all, lol.
April 17th, 2012 at 7:02 pm
You have GOT to be kidding me!!!!! Borrow 5,000 and pay back near 40,000??? Ya right!!!
April 16th, 2012 at 6:29 pm
You may not think it is fair but if you don’t read the fine print and agree to take their money, that’s your problem. Don’t blame the folks that came up with it. I know the economy is in the tank. Hell, I have been out of work for over a year but I am still not that desperate.
April 16th, 2012 at 12:37 pm

Western Sky was a God-Send for me after I had a car accident. The people are friendly. This type of loan is one that you take ONLY if you have a plan to pay it back in a lump sum rather quickly. I took the loan knowing that I was 30 days away from my end of year bonus. I paid in full, and life was good!

I’ve heard that since Westernsky operates in an “independent nation” of the reservation that they have no means of using Federal law to force you to repay.
April 5th, 2012 at 1:13 pm
Ok, so submitted for a loan and approved no different than payday folks other than Western Sky (SKY-HIGH) rates. Ok… so needing the money… (better to wait) went forward and they started to fund the loan however, because I use two different checking accounts they determine what account. At an SKY-HIGH rate they should be more flexible about what account they try to deposit to… so Spoke with Chris a Sup. of Cash-Cow and this is their rules and I think this is stupid so I stop the funding keep your money. Not to mention they get rude when you want to cancel. Sorry I will keep my money and not pay you 60% of the next person’s loan. So fyi folks before taking a loan out from these loan sharks keep in mind your 60% funding the next loan and if you go the full duration of the loan in repayments you will pay easily ((2-8 * (original loan amount)) = To Damn Much. Please avoid!!!!

It seems that most of your problems are due to the fact that the company is owned and run by a Native American. I don’t hear any negative feedback on all the American-European payday loan companies or the Title loan companies that are ripping people off on a daily basis and causing people to lose their cars, because of their high interest rates.
Come on people I hope you don’t decide to vote the same way!! Rather be fair and conduct research on a persons character and integrity before you make your final decision. At least Western Sky tells you up front that they are costly, do the other loan companies tell you the truth or do you find out after you get that first bill? Why do you think the government is now monitoring the white-owned loan companies?? For the very same reasons you say Western Sky should be closed down. All I ask is that we learn to conduct our research, rather than just jump in and agree with everyone else’s comments, negative or positive.
And NO I am not a Native American, I am an African American, and we deserve the same GOD given opportunities and respect as the rest of our American sisters and brothers. Heck the Native American deserves it more than any of the rest of us Americans, because contrary to popular belief, Columbus did not discover America.
Rather your founding fathers, came to America, killed Indian men, women and children, stole their land, and continue to this very day to break the many promises they made to them. AND all of this took place after your ancestors took over one of the greatest continents in the world, Africa. Your founding fathers subjected my people to 400 years of abuse, hatred, torture, slavery, and you all continue to do so even to this very day.
It is time to stop the discrimination based on the color of ones skin, and it is time to judge people, and their businesses based on the facts. It is obvious to me, that most of you really don’t know your own history, based on your comments, it appears, that you are simply following the crowd who obviously has a bias against Native and African Americans.
If you conduct research, and historical facts, you will see that it was your ancestors who, are the savages. They were murderers, liars, and thieves, and because of their horrendous acts, I have no knowledge of my ancestral heritage. I am African American, because my history is from African, but because of what your ancestors stole, I am just as much American as you are, and because they were here first, and Columbus cannot discover something that already exists, Native Americans are even more American than any of us are.
So can we all accept the fact that we are all Americans. We, Native and African Americans have had to adjust to the lifestyle handed down to us, by white America. While it was unfair life we have tried to move on, we hold no contempt, even though we have every right to.
It is 2012, and white america still acts as if we are the problem. We are not. So if I ask that we stop the discrimination based on the color of ones skin, and voice our opinions based on facts, and for all my white american sister and brother’s,forget what you have been told, about us, and please conduct your own research. You will find that African and Native Americans are peaceful people, and we keep our word.
You will also learn that each and every time we stood up against oppression of any kind, it was due to who was running this country at any given time,i.e. (Abraham Lincoln and the Emancipation Proclamation) and/or Reagan and the Bush administrations, with that dang gone Reagonomics. It is 2012 and I can tell you I for one as an African American will not vote for Romney, not because he is white but because of the content of his character. He says things like we want to take America back to where it was. To me it means forget the poor and oppressed that his forefathers made, and continue the discrimination and abuse.
It is time to stop this madness, and hatred, especially since white american’s are the ones who started the whole thing. Do not vote as you responded to this post, but vote based on the content of the persons character and not the color of his skin.

I applied for a loan without knowing all of the details as I was in a bad situation and needed the money (for expensive car repairs). I was approved but once I found out the repayment terms, $500 a month payment for 84 months on a 5K loan, I said forget it.
I was called daily, sometimes several times a day, and pressured into taking this loan. I stood my ground and refused. After several weeks of daily harassment, they sent me a letter stating my loan application was denied and they would report it to the credit bureau.
They are a sleazy, predatory company and if you don’t cave in to their scam loan they intentionally decline the same loan they initially approved you on. I firmly believe in Karma and know they will get thiers one day.

I can’t believe they can operate the way they do. I saw their commercial and thought maybe I could borrow. I knew it would be alot to pay back, but it was ridiculous. I was approved for $850 but when it came to sign the paperwork, it was going to be $500 deposited in my account after all the fees and in the end $1800 would be paid back. That’s ridiculous. I cant believe they can get away for that. I feel bad for anyone that does the loan.

What rights would you have in a tribal court against a member of that tribe? Absolutely none. In fact, the tribal council very likely is made up of relatives of the company. If you don’t pay on your loan, you literally could lose your house, your car, everything you own or ever will own, and the U.S. courts would be obliged to help the tribal court take you to bits. Bankruptcy? Not unless the tribal court allows it (which they wouldn’t). Remember, they’re a sovereign nation.

These commercials irritate the heck out of me. It’s predatory loan sharking at best. Understood that Western Sky is not governed by US State Laws intended to protect borrowers from extreme APRs and payback schedules… but why aren’t their provisions in place governing what television stations operated in the US can air or profit from in terms of advertisements intended to mislead or cause harm? It should not be legal for a “US Based Company” to advertise and promote services that are clearly in direct contradiction of “US Based Laws” that have been put in place to protect the general public. I’m a very concerned citizen and would like to know what I can do to stop this. Who would I write to? If anyone knows, I would like to know.
“In the US, individual states have laws that govern payday loan companies and are meant to protect the borrowers from extreme APRs and unrealistic payback schedules.
In the past when Reviewopedia has reviewed online payday loan companies, I have pointed out that borrowing from an online company that is based in another state may make it difficult for your state laws to protect you from predatory lending practices.

people the only reason you should ever take a loan like this is if you ill be able to pay it back within one month of borrowing this money. Unlike credit cards where you can ride something out for a year and not be charged an OUTRAGEOUS sum of money, you must urgently need this money and know for certain that withing a very short amount of time that you will be able to pay back the whole loan within a very short amount of time. for example if you borrow 2 grand make sure that you are going to have whatever you need that 2 grand for, and the 2 grand you were loaned. If not then you will end up paying 40,000 for 5 grand.

I disagree. If you have the means to come up with an extra $2000 cash within a month, then you don’t need a $2000 loan ‘like this’. You may need quick access to funds but you could use a credit card or take out a loan with a more reasonable interest rate. The only reason why someone would need a $2000 loan ‘like this’ would be if they couldn’t use a credit card or take out a loan with a more reasonable interest rate. The only reason why someone couldn’t use a credit card or take out a loan with a more reasonable interest rate is because they’ve already maxed out their credit or have terrible credit as a result of not being able to pay off debt. If you’ve already maxed out your credit or are unable to pay off debt, you’re not a person who can come up with an extra $2000 cash within a month. You would be someone who needs real help in the form of credit counseling.

I have been trying to complete the loan with Western Sky and now all of a sudden the wiring process is the cause that the money has not hit my account yet. I was expecting the money to be there for something very urgent that I needed and it is not there and I keep getting the run around. I am about ready to cancel my request since nothing has hit my account and ride my urgent situation out. I will never do this again, also closing my bank account since they have it already.

And, you are not a dumbass. No one is because many, not all, companies really are marketing in such a way that you will take their bait. I studied marketing and it really is all about knowing everything about consumers…that’s you and I…so that it will be very difficult or even impossible to refuse. For you, it could be related to a need, maybe to a desire to be entertained or another more “you-involved” reason. Whatever the reason, say no next time and either do without it or find a way to get what you are looking for in a legal and honest manner.

You could always seek bankruptcy, have bad credit for seven to ten years, and cut all of the debts that you can in order to start over. You may want to think about buying a parcel of land real cheap and paying it off as soon as you possibly can. There are a lot of land brokers out there that take small downs and small monthly payments, from Oregon on over to Arkansas. And, there are ways of earning enough money to pay yearly property taxes and give you a little extra to get by on and pay for some things. Also, if you cannot get a bank loan, you need to stay away from those whom are seeking a reward out of their lust and greed for money…using you to get what they want…stupid smart sharks! Most of them will sound like they want to help you and are very giving but, behind the scenes, they are only waiting to check their bank accounts to see how full and fat they are. The more personal and catered companies make it for people, the likelier they are to get what they want ($).

Probably better to risk committing fraud than paying their outrageous interest rates. My suggestion? Time for you to move to Mexico!
Cheryl says:

Correct me if I’m wrong but my understanding is that fraud would be if Jennifer gave false or intentionally misleading information in order to be approved for her loan. Closing the account because she’s no longer able to make the payment may cause her to go into default with the lender but isn’t necessarily fraud unless it can be proven that she never intended to repay the loan at all.
Jennifer, some state laws do allow for prosecution if you close your bank account but that is usually in the case of fraud. I agree with HB and suggest you contact a debt counseling office in your local area for more information and assistance.
On a side note, some banks have a policy that allows them to force open closed accounts in order to process ACH transactions that may come through. If this happens, you then owe THE BANK those monies that were withdrawn from your closed account. If your bank has such a policy, the only way to stop monies from being withdrawn is by requesting that they put your account on deposit only, an ACH block or a hard hold. I am NOT suggesting you do this, I’m just pointing out that your closed account may be accruing a negative balance and you should be aware of that. Go seek help in the form of a reputable debt counseling office and best of luck!!

By closing your old account you have committed fraud. If Western Sky can prove that you received and spent there money and deliberately closed your account after not being able to make payments, they can definitely sue you or worst press charges. This is a serious matter, do not ignore. Try to contact them and settle the dept. Remember they have your personal info and will do what ever it takes to get there money.

Suggest you contact a debt counseling office in your local area. Many of these operate as taxpayer funded entities and so the cost to you for their services and advice is small … but also be advised that some of these “credit counseling/consolidation” companies actually work for the people you owe money to …
I hope you learned your lesson …

I have never dealt with a payday advance company. But after the commercials I did a lot of research on Western Sky. It is a total scam! They will give you the money, but you are completely unprotected by any state or government agency because they operate from an Indian reservation. No matter how bad things get, there is NO WAY IN HELL I would pay $40000 for a $5000 loan! Hit your 401k or something if you need money. Anything would be better than giving business to a money hungry company like Western Sky.
Apothem says:

I agree. However, I’m going to take a wild guess that Western Sky’s target audience doesn’t have 401(k) and IRA’s.
March 7th, 2012 at 6:02 pm
Okay lets look at this in it’s entirety people! There can very well be a penalty for not paying back loans from Western Sky Financial. Basically what’s going on here is that the tag team is using the Indian Reservation to avoid usury laws in every state of the country. Part of the “Western Sky” agreement contains a clause in which the borrower waives all rights to a trial, any lawsuits, or any form of court hearings/decisions regarding the loan. So you sign up with Western Sky who is legally allowed to pounce on you with these high rates; all the while hoping you don’t see the rights that you’re giving up. THEN .. 3 days later they sell your agreement to a U.S. based firm, Cash Call, complete with rights signed away which would give them the ability to run you down legally if you don’t pay. And YES you can be incarcerated for passing bad checks; which is essentially how the repayments are structured. Anything is better than this scam! I’ve never attempted this or any payday loan service but since I’ve been seeing their commercials pop up everywhere curiosity got the best of me and I decided to do some reading. …
NOW … Here is a thought. According to “Western Sky” any borrower can reject the arbitration clause that strips all of your rights away by informing them IN WRITING within 60 days of the loan close. WHAT IF?? The borrower included in that letter a statement that read: “no transfer of debt or loan will be recognized by the borrower; and borrower only enters into agreement with Western Sky Financial solely; holding of this loan by any other organization or firm will void loan agreement.”
Since the terms for Western Sky clearly state that NO U.S. federal or state laws shall apply to the loan agreement nor do they make mention of consenting to another company or having the debt sold. My thought process is that if you include that statement on your arbitration rejection letter could their hands be tied? Could you then in fact take out a loan, close the account and say “go pound sand” you sold the loan and I didn’t consent to that? Thoughts anyone?

Just an FYI…The FTC filed action in U.S. district court, a payday lender that allegedly attempted to illegally garnish consumers’ wages has agreed to stop the challenged conduct pending trial. On September 6, 2011, the FTC filed a complaint for permanent injunction and other equitable relief in US District Court, District of South Dakota, Central Division, that alleges that Payday Financial, LLC, doing business as Lakota Cash and Big Sky Cash, along with other defendants, including Western Sky illegally attempted to garnish consumers’ wages without obtaining a court order, to collect payments on payday loans. As a result, the defendants illegally revealed consumers’ supposed debts to their employers and deprived consumers of their right to dispute the debts or make payment arrangements, the FTC alleges.
According to the FTC, defendant Martin A. Webb operates Payday Financial, LLC, and several related businesses in Timber Lake, South Dakota. The defendants offer short-term, high-fee, unsecured payday loans of $300 to $2,525 to consumers throughout the country, advertising on television and through websites such as www.bigskycash.com and www.westernsky.com
The FTC complaint alleges that when a consumer does not pay back a payday loan on time, the defendants send documents to his or her employer that mimic those used by federal agencies collecting debts owed to the government in an attempt to garnish the consumer’s wages. Under federal law, the government can directly require employers to garnish wages for debts it is owed without a court order. But private creditors must obtain a court order before garnishing a debtor’s wages. The complaint charges the defendants with violating the FTC Act by: ⦠misrepresenting to employers that the defendants are legally authorized to garnish an employee’s wages, without first obtaining a court order; â¦falsely representing to employers that the defendants have notified consumers about the pending garnishment and have given them an opportunity to dispute the debt; and â¦unfairly disclosing the existence and the amounts of consumers’ supposed debts to employers and co-workers without the consumers’ knowledge or consent.
The complaint further alleges that the defendants have violated the FTC’s Credit Practices Rule by requiring consumers taking out payday loans to consent to have wages taken directly out of their paychecks in the event of a default, and have violated the Electronic Funds Transfer Act and Regulation E by requiring authorization for electronic payments from their bank account as a condition of obtaining payday loans.
The Commission vote authorizing the staff to file the complaint was 5-0. The FTC filed the complaint and a request for preliminary relief in the U.S. District Court for the District of South Dakota, Central Division on September 6, 2011. The complaint names as defendants Payday Financial, LLC, Great Sky Finance, LLC, Western Sky Financial, LLC, Red Stone Financial, LLC, Financial Solutions, LLC, Management Systems, LLC, 24-7 Cash Direct, LLC, Red River Ventures, LLC, High Country Ventures, LLC, and Martin Webb. On September 7, 2011, the parties agreed to a stipulated preliminary injunction to immediately halt the alleged unlawful conduct, and the court accepted and entered the stipulated preliminary injunction. The FTC would like to acknowledge the assistance of the South Dakota U.S. Attorney’s Office.
This case is pending. For updates or further details concerning this case, please contact the Federal Trade Commission.
These people can say what they want, but when they break the law, the feds will come after them. Both the state and federal attorney generals need to hear about anything you think is illegal as well also. Cash call is next. They are telling clients that they are indian/native american and that they can raise the interest rates whenever they want. It’s only a matter of time. Record every single conversation and keep every email. These people are overconfident and stupid. The ftc caught them falsifying wage garnishment documents—they were making them look like they came from the irs. Not good. Western sky is a bunch of crooks. Watch out… I’ve caught scammers falsifying court documents (stamped with docket numbers).

If you include a statement that purports to “void” the agreement upon some action by the parties the ENTIRE agreement would be void–including the part where Western Sky agreed to tender the loan. Thus you would have to give the money back. Keeping the money would act as a waiver of your attempt to “void” the agreement. You cant cancel just one half of a contract and plot to get a windfall.

I forgot to mention that if you did take out a loan through Western Sky make sure to have your letter of arbitration rejection NOTARIZED the same DATE as your loan was taken out and send it certified. … I’m thinking that since Western Sky explicitly circumvents ANY federal or state laws governing the loan that should you default the sword becomes double edged; not only can YOU not seek state or federal assistance but neither can they! .. Unless Western Sky wants to send tribal members to your door to get the money they’re beat .. and even then .. trespass them!
March 7th, 2012 at 3:21 pm
Ok, so let me explain my reasoning for even considering a loan through not just WesternSky or anyone else for that matter.
My husband is out of work waiting for disability because he can’t work.. Dr’s have told him that if he does then there is a 98% that he can paralyze himself (he has slipped discs in his back, had neck surgery a year ago, and has no feeling or movement in his left arm).. in the meantime, Disability has denied him twice. Now we have a lawyer involved however they tell us it could take up to 3 year for approval. We are going into our second year of waiting for something to happened. Yes, we know this is no guarantee that he will be approved however we will will deal with that as it comes and there are other options after this…
In the meantime, I am the only one working. My husband does little things to earn money like give blood, helping family do small stuff like taking care of our niece/ nephew but those little things don’t pay all of our bills and with his condition there is not a lot he can do. We have cut corners as far as we can but we still have problems. We have talked numerous times about forgetting about his disability but do we really want to take a chance that he will become paralyzed by doing anything extra? No, I don’t think so!
Last week, I received a garnishment from a company that didn’t want to wait for a measly $100 payment each week, so instead they will garnish anywhere from $300-500 (depends on what I make each pay period). This will ONLY last 7 months… This will leave us about a grand total of $1000 a month to pay bills. That is not including a $800 rent, food, and utilities that I couldn’t cut corners on. We have sold most of our furniture to make payments on stuff, but it’s just not enough. I have another part time job that unfortunately is just that… part time and when they need me. I’d be happy to work 3 jobs if I thought it at all possible but well, it’s just not!
All of that being said, we were going to attempt this (thinking it would be short term and we are getting taxes back so we could pay what we borrowed anyway once we revived our refund)but looking at all of the comments on here and on BBB, I think I will skip this. I don’t want to ad anymore headache to the ones I already have and I don’t want to get in debt with a company that will just take me for everything I have anyway.
To those of you that said that people who are unemployed and are (basically) irresponsible, scum, not wanting to pay our bills, that are the ones who want to use this service… you are wrong. Not all people are like that. They (like my family) are just struggling because of circumstances beyond our control. We have done all we can, taken steps to ensure that our bills are paid but truth be told, when things happen, and you need help, most of us try to pay those people back but stuff happens. In my opinion, those of you that make dumb comments like that, are probably those people you are describing!!
All in all, this company just sounds like a fraud and someone I don’t want to do business with… so thank you to those smart and knowledgeable people who have give constructive and useful advice… I appreciate it. You have probably saved my family from some more hassles that I don’t want or need!

Stephanie,
My husband and I went through something similar. Only my husband had a stroke and was left paralyzed on his left side. It took us 3 years to get him disability. We finally retained a company owned by an individual who used to work for social security/disability. His first and most important suggestion was to write our elected representatives, both congressman and senator. Within 3 months my husband was approved. Hope this info helps. Keep the faith, there is a light at the end of the tunnel.

With them being a sovereign nation outside the US if you never paid them back would there even be anything they could do to you? They can sell the contract to a US company to enforce or they can get a tribal judgment against you and register it in your state as a foreign judgment to be enforced against you. There could be no international commerce if inter-sovereign contracts could not be enforced.

So what I have learned is this and read carefully… by the laws and consumer protection acts when a loan company gives a loan and then sells your loan to another and that company does not issue a privacy act to the consumer or get a new signature with their loan terms then the original loan agreement becomes nul and void. The new loan company that the loan was sold to has to have your written consent to their policies and therefore can be held liable in the state courts for theft and fraud. If they withdraw anything from your account without your permission. So previous statement from robert and scott are true that it then becomes free money. Western sky tries to make it sound horrifying about tribal laws when in all reality they sell your loan to a non tribal company….. think about it!
CREDITOR says:

The above is not true. Poster is combining various fragments of consumer law with rules that only apply to “financial institutions” which is a legal definition. Not all debt buyers are financial institutions by definition. Trust this to your detriment. Consult an attorney. Too bad so many people on this site are trying to find a way to get “free money”. This loan is a bad business deal for the borrower unless you need the money for 30 days or less…end of story.

I too am Native American(Oglalla Sioux). Out of curiosity I tried to get pre-qualified and Thank God, they turned me down. I have poor credit and they turned me down flat! I am sooo greatful! I now know that I don’t have to worry about my own people ripping me off but that they outsource the misery. If you have poor credit don’t bother either.
They don’t even have the nerve to put call centers on reservations where they at least speak and understand English clearly. Young Native Americans are being disserviced by their own kind. Everyone should already know that most of the smaller tribes live below the national poverty rates and would be greatful to have even this kind of job.
I know there are a lot of people coming up short these days and it seems like the vultures are always hanging around. Not all people who have tried payday loans are stupid, they’re just a little desperate and cornered by life. I you use them, manage them wisely.
If you owe them and they are threatening you, contact your state attorney general and file a complaint. Most of all let them all know up front that you are well versed in consumer protection rights and that if they continue to harass you, you will be seeing them in court first. There is no reason to argue back because most of them aren’t on US soil anyway.
I will pray for everyone and this great country we call home!

My brother in law is a very successful man, working for tribal housing for his tribe. I have watched his family succumb to addiction, mishandling of funds, and unemployment/underemployment. When I saw this commercial my heart broke for his people because they are set up to kick people when they are down. Much like the payday loan places that are marketed towards young military, this company offers “hope” to someone while they are down. Offering “quick cash” through a tough time. Unfortunately, all this is doing is making tough times tougher, and lean times leaner. What a blessing you were denied, hopefully God will bless you in a way that won’t harm you like this company would.

Western Sky sells their loans off to Cash Call (which is actually a part of their whole scam), in a matter of three days. They do not tell people that their loans are going to be transferred to Cash Call. Also, when asked to explain why these loans are sold so quickly, an individual is only told to read their loan agreement. Western Sky/ Cash Call will not provide a paper copy of the loan. These loan sharks are taking advantage of people who are desperate. My question is, since Cash Call has bought these loans and they are not on a reservation can something be done about the high interest rates that’s attached to these loans? Cash Call maintains that they are NOT a payday loan company. These individuals are nasty, ill-mannered and deceitful people. People turn to these loan sharks because banks will not give out small, short term loans to people , even if they have decent credit.

What am i missing here? There are times when you need money NOW, such as bail bonds, tax bill, or medical expenses. You aren’t in it for the long term because you know what the interest is. There is no penalty for paying it back ahead of schedule. They can get you out of a tight jam and then you pay it off in a few weeks. Done.
Joe says:
March 7th, 2012 at 6:23 pm
That argument is nearly irrelevant to me. First off we know that firms like this aren’t marketing to individuals who will pay it right back in two weeks; that’s never the way it goes. If you could afford to pay the entire loan off in two weeks you wouldn’t have taken one in the first place.
Debts like taxes or medical bills can be arranged on a payment plan and with regard to a bail bond you can either put up collateral or if you have none and you have a solid case your attorney may handle that for you; if you don’t have a strong defense and are in jail an attorney likely won’t assist you with this and probably shouldn’t.
The reality is there aren’t situations that are soo pressing that would justify the type of “rape job financing” these people are trying to push. Filing bankruptcy would be preferable to this.

You are probably correct, however the credit bureaus that these guys pay fees to will most likely not care, and people who need $5,000 from TV shylocks generally do not have degrees in contract law.
This is probably one of the most wisely created schemes in history and does manage to circumvent state and federal usury laws and if the regulated banks could even make 25% of this companies fees they’d probably be in violation of lending standards. Unfortunately we have a legal structure in the US that allows even unreasonable contracts to be pursued to a greater extent than criminal complaints.
About the only person who conceivably could make this loan situation work and make money outside of the lenders would be a criminal themselves. For example if you can buy a bulk load of meth for $5,000 and put it out on the street at a 200% markup and can sell the crap in a week, theoretically you could pay back the loans interest and even a hefty $500 loan fee you would end up with over $4,000K spending cash.
The real anger should be at the TV stations that air these commercials like WGN and some cable networks, and they would have far less people to take advantage of if WGN and others were not co conspirators by allowing them to advertise.

First and foremost, I am of very strong Sioux heritage. And one thing I would like to do is apologize on the behalf of the rest of us who are not out to bleed America dry during the worst of it’s times.
However, I do fell quite compelled to remind everyone that insists on making the “white man” and “red man” comments.
Your points can be made without such degrading remarks. I say degrading only because slurs such as this have never been used without ill intent. You may as well just refer to us a “Injuns”, while we refer to you all as “Rapist thieves”.
The fact of the matter is that neither of these remarks refer to even 5% of our (or your) population. As such, it would be completely ignorant of I or any other to do as such.
On topic; While the reservations have been given certain rights and immunity, it is not the reservations themselves that are abusing this, but rather select individuals with little to no regard for quality of life within this great nation.
Many of you can look down upon those with badly beaten credit, no jobs, an abundance of children, or various other situations. However, to refer to such a generally assuming stereotype as “deadbeat unemployed”, is showing nothing more than your ignorance.
While everyone may have the ability to cure their situations, provided the proper opportunity arises to allow for it, not everyone chose the situation they are in.
I have never gone a day in my life without work. not since the age of 14. I am now 37. That is 23 years of constant work. I make a very nice sum of money for my work, and live an extremely posh lifestyle. Yet, I still have never stooped to the levels as some of you, and those of my people who decide to work within the “gray area” of the laws.
Not only should those involved with Western Sky be held responsible, as well as those who willfully and knowingly partake in WS’s loan program, but so should all of those who merely assume that those who accept WS’s offer and rates, are nothing more than low life, credit lacking, financially irresponsible, and undeserving rats.
There are times and scenario’s that arise in life that need quick resolve and limit options severely, even those who are “financially blessed”.
If you do not know of the reasons, then you have no right to speak of it.
As far as closing remarks of Western Sky, CashCall, and other involved in these ploys…The day will come at which you will answer for your tactics. One way or another. When the tables turn, which side will you be on?

I am currently trying to teach democrats and republicans to respond to each other this way. I feel people really have to learn to have intelligent conversations instead of just trying to beat each other down with their words and hate. The reason we are the species at the top of the food chain is out brains and I just wish everyone would learn to actually use it at all times instead of just spewing ignorance.

Just for the fun of it and out of curiosity, I went to the Western Sky website just to see what the interest rate would be….for a $5000 loan, you would be subject to a $75 loan fee and about 116% interest…with an 84 month!!! pay schedule at $486.58 a month..by the time you pay off the loan you would end up paying back $40,872.72.!!!!! I don’t know how they in good conscience could give people these loans..but then again if people are dumb enough to take them…

Its a Shame. So the person in debt ends up deeper in. It is sad.
February 9th, 2012 at 4:17 pm
How
You talk about the white man screwing over your people. Borrowing $5000.00 and paying back 84 payments of $487. Comes out to over$40,000. Kinda funny, really.

Don’t do it the upfront costs are a killer alone. Borrow 500 you owe 800 but get 500 IN FUNDS plus pay back approx 135 a month for a year if you are going to faint from starvation its a good choice .other then that NO WAY AGAIN. NO NO WAY

I reviewed this company with the Better Business Bureau,as I do with any company before I do business with them, and the complaints were many. I’m not sure of the date as it wasn’t stated but the Colorado Attorney General had filed a lawsuit against Western Sky for making unlicensed, high-interest loans to Colorado consumers. So if anyone has questions or wants to find out about a business go to the BBB,Western Sky is listed.

It’s a good choice if your bookie is sending guys to break your legs. On second thought, it’s cheaper to get surgery and miss the time out of work. To get $1000 cash you have to repay $3000. If this seems like a good deal to you, please don’t have kids. The fact that this is allowed to operate within the US is proof that the government cares nothing for you.

Given that the U.S. banks and finance companies can’t make good on their loans to people that live in the confines of an Indian reservation, how can Western Sky make good on loans to someone outside of their Indian reservation? I also have to wonder why any bank on U.S. land would make a loan to anyone that lives on an Indian reservation or has ties to one.
AZ Sun says:

Anyone who operates within the confines of an Indian Reservation can not be governed by the US Government. If one of there owe goes past due on their vehicle, the finance company CANNOT go on reservation land to reposes the vehicle. The answer is to do your homework and know your rights.

You people are all MORONS! They tell you what the APR is up front, in the mail, via email and over the phone numerous times. I borrowed $2552 at 139% APR. It ended up costing me $389 in the end. I had the money for almost 8 weeks.
This is for people who need cash quick with expectation you will repay it QUICKLY.
Its not for the deadbeat unemployed and trust me you wont be approved anyways.

The people are MORONS and so are you who think that this is a good thing. I researched your statement of 389.00 total cost to you. Your not teling the truth Tcboston. I called the company and no matter when you pay it back the standard loan repayment will cost you no less than 1000.00 even if you pay it off in 30 days.
i can say this, at least they are hones tabout ripping you off, bending over without lube and taking it in the butt.
The problem here is that they dont operate a buisness that has to adhere to state and federal regulations, so they can do as they please. People who fall into the scams and the OMG what am I going to do when something happens gets sucked in by these type of Lending Practices. Like I stated before post some resources somewhere on Google for people to get assistance by the US Government, it is out there. Food Banks, Welfare Department, WIC, Cash resources for veterans, military members and their families…
January 27th, 2012 at 5:46 am
I was on the phone with these people contemplateing taken out a loan but then decided to do some research first, THANK YOU ALL. After reading all of your comments…especially the amount I would be paying back…HELL NO!
January 25th, 2012 at 2:53 pm
So many people on here keep saying that the USA needs to find a way to keep people from getting ripped off from these “scams”. Ummm… why?
The people can easily prevent themselves from having to pay these interest rates and fees by reading the information that is freely given right up front in plain print, and making a grown-up, adult choice. I think if even after folks are reading these insane rates and still signing on, that this is definitely a business I’d like to get into and I don’t see why it’s against the law for me to open a similar loan company.

I’d rather starve to death than take out a loan at 116.73% annualized yearly. Some people might not see the catch here, but don’t do it to yourself. Get an advance from your credit card if you need to. This is just absolutely crap. And since it is not regulated by how credit card companies APR cap at around 28%, they can get away with this sort of absurdity.

January 19th, 2012 at 7:07 am
This is not a review of the company who is ripping people off as they(company) tells you upfront that they(company) are ripping you off. This is a review of the so called American Public. What a bunch of morons! You come to me to borrow money and I tell you how much you have to pay back and you still borrow the money then complain about my rates. Duh. Let’s blame the government for not controlling even more than what they have now. Let’s blame the law makers for not making a law for YOUR STUPIDITY! Whatever we do for the love of Pete let’s not blame ourselves. Why? Because nowadays were are told that we are(wait for it) “entitled”. So what we want is total protection from anyone or anything which will then allow us to go on being stupid. No consequences for you actions. Did you not learn anything as a child. Did you ever fall? Why? You mean that someone wasn’t there 24/7 to make sure that you didn’t fall? Let’s make a law for that. WAKE UP PEOPLE! Pull you head out and grow up and start taking responsibility for you own actions.

Well Gee Dave, did you ever think that there are people who are in the country who actually have to PAY taxes and mortgages, etc, who aren’t going to get a free ride based on their race? Talk about entitled. People get backed into a corner and have no where else to turn when they see a commercial on their t.v. about getting up to $5000 with no credit check. ‘Expensive’ money starts to sound pretty good. Just think about all the poor people who don’t have internet access to look these guys up. If American law does not apply to them, then they shouldn’t be able to advertise on our stations to our people. If it wasn’t for us ‘Morons’, You and your company would be out of business. And don’t act like you all are not using the “government” and “lawmakers’ to your benefit as well. Oh my Dave, seems like someone has sparked your flame. Let me tell you what you and YOUR company is doing is wrong. If you want people to post positive about YOUR company then you need better business practices. Charging someone this amount of money is insane. How do you sleep at night knowing that you just made a killing off of someone who is already struggling. I understand they make their own choices but come on.. This is absurd and if you had any balls, you would open a business people could respect and people could walk into to discuss their financial needs. Another way of taking advantage of your rights as an American Indian by not having to follow the same laws and regulations the American People have to follow. I can say your honesty is appreciated, however that is what sparked my curiosity.. How expensive is it? LOL, well Mr Dave from Western Sky, I think that you need a drink and maybe think about what you are doing to people that you somehow in your twisted business practice thinks is ok to take advantage of people. SHAME SHAME.. I think that I will write a point Paper to the US Congress and report this. I am sure there is something in place; somewhere that they can reference that what you are doing is illegal.

January 10th, 2012 at 1:31 am
I just saw their commercial and went to their website. This is a SCAM. The trick is to get a person to take out the higher loan because the fee is low and pay it over time. I thought there was something wrong with my math when I calculated the payback. $5,075=40,872.00
Really? You are in more debt than ever. This is a pay-day advance loan with the option of paying it back over time. To avoid the high interest, an individual would have to pay it back in 12 months.
January 9th, 2012 at 9:58 pm
I took out the loan and them cancelled it within hours after I compared what they charged me versus what the rep said over the phone. I live in Texas, how does this affect me?
Sarah says:

January 5th, 2012 at 5:12 pm
In Florida its against the law to charge a high interest rate. Since they are not licensed in Florida they cant take you to court if you don’t pay back the finance charges. Florida court will refuse the charges because the loan is not based in Florida. Our local news station had a lawyer on (Help me Howard WSVN 7) and the young lady paid back the $5,000 she borrowed and told her that if she doesn’t pay anymore money back besides the $5,000 that they will be forced to take he to court and that no judge in Florida will allow the case. They are out of luck in Florida. All online loan companies charge over 100& APR. Be wary.
Dave says:
April 23rd, 2012 at 9:14 am
So the usury laws in borrowers’ states actually DO apply here? The real suckers are the ones actually paying the interest – sounds like whoever borrowed the $5k and paid it back at 0% did things right (presuming she had no negative repercussions on her credit in the long term).
January 5th, 2012 at 2:34 pm
It’s sad how people use people in debt to make money.smh just have to be more careful. always read before you sign. whats really ashame is that they said that they are lower than a payday loan. they are really not.
January 3rd, 2012 at 10:24 pm
I am actually a bill collector for a major credit card company that doesn’t charge high interest overall.. This company is charging interest that should def be illegal. But…… No one is making anyone sign the contract. You really cant blame them if people are willing to sign on the dotted line to agree to pay those fees..
January 3rd, 2012 at 4:28 pm
I haven’t taken a loan from these people and want to warn people not to take the loan….this is legal usery!!! The last commercial i watched from them they offered 5,000.00. The loan rate was 116.73% and the small print even indicated that a typical 5,000.00 loan with payments of 486.50 per month for 84 months…this adds up to 40,866.00 total that will be paid back…Don’t take these loans…you also have to sign an agreement that you agree to be bound by the tribal court and that no other courts or governments will have any jurisdiction over the loan. Please watch this closely and don’t take the loan

The problem here is the US Government can not regulate a sovereign nation. They get away with this because they do not have to adhere with the US Government. They are really an insult to the Sioux Nation. Also, in a recent article I read that they are a part of CashCall which is skating around the law by (abusing) using the Indian nations for their scams. Unfortunately, none of the nations are profiting from this industry. Another classic sign of the white man abusing the red man. I call it Legalized Slavery.

I think it is funny how everyone blames the “white man”, exactly how greg said. people know what they are doing. I live in an area where there are American Indian Reservations everywhere. Do I care that they dont have to listen to the governemnt, of course.. I have to. We all have to pay taxes but is anyone worried about the abuse of the welfare system? Do people know that in society, a person who receives food stamps for a family of 3 gets around 750.00 a month depending on where you live for food. Yet they spend maybe 300.00 on groceries and “sell” the rest to people.. 100.00 for 200.00 worth of stamps and thats how they survive the month. There are scams every where, it is a shame. If people; white, black, indian, purple, pink ect…ect.. , had any common sense the world would be better. Everyone is trying to get over on the next and the sad part is we can type our pretty little hands off and no one cares. The fact of the matter is that if you get a loan where your payments equal the amount of a new car by the time you are done, then umm where is the common sense factor? Why is it that someone can pay 489.00 a month for 84 months but they need a loan like this for emergencies.. I am a single parent with a FULL time job, going to college and maintaining a home. There are so many resources for people to get help that wont bury them in something like this. What people need to start posting is resources to assist people instead of getting in more debt. proactive..Not reactive..

Western Sky sells these loans to a company called CashCall within a matter of three days. There has to be something illegal regarding these high interest loans . CASH Call maintains that they are NOT a payday loan company so how on earth can they charge the high interest rates that started out with Western Sky? When I asked about their policy and if they were involved in scaming people who are desperate, they hung up on me. Imagine that!!!! These people need to have a class action lawsuit filed against them.Remember, Cash Call is not on an INDIAN RESERVATION.
